These Terms govern your use of the website and services offered by Upsta Analytics Pvt Ltd (“we”, “our”, or “us”). By accessing our platform or website, you agree to these Terms.

1. Scope of Service

We provide a subscription-based SaaS platform for advanced Order to Cash analytics and automation. Access is granted to registered users under a client subscription or trial agreement.

2. Acceptable Use

You agree to:

  • Provide accurate registration information
  • Keep your login credentials confidential
  • Not misuse or reverse-engineer the platform
  • Use the platform only for lawful business purposes

3. Intellectual Property

All website content, software, analytics models, dashboards, and branding are the intellectual property of Upsta Analytics Pvt Ltd. No content may be copied, republished, or reused without prior written consent.

4. Data Ownership & Responsibilities

  • Client Data: All data uploaded to the platform remains the sole property of the client.
  • Processor Role: We process client data only for service delivery under signed agreements.
  • Analytics Use: We may use anonymized and aggregated usage data to improve platform performance.

5. Data Processing & Privacy Compliance

We comply with applicable privacy laws (including GDPR, CCPA, and Indian IT Act). A Data Processing Agreement (DPA) is available to clients upon request.

6. Service Levels & Support

We aim for 99.9% uptime availability, excluding scheduled maintenance. Support is available via hello@upstaanalytics.com during business hours (IST). Critical issues may be escalated as per the client SLA.

7. Suspension or Termination

We may suspend or terminate access if:

  • You violate these Terms
  • There’s unauthorized access or system abuse
  • Subscription fees are overdue

Upon termination, clients may export their data within 30 days before permanent deletion.

8. Limitation of Liability

To the fullest extent permitted by law, Upsta Analytics Pvt Ltd is not liable for:

  • Indirect or consequential damages
  • Data loss caused by user-side actions
  • Delays or failures due to events beyond our control

9. Governing Law

These Terms are governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka.

10. Amendments

We reserve the right to revise these Terms. Updates will be posted on our website with the revised effective date. Continued use implies acceptance.
